Guwahati, October 30: The Assam government has approached the Supreme Court challenging the bail granted to Amritprava Mahanta, an accused in the case concerning the death of popular Assamese singer Zubeen Garg.
The state government filed its challenge on Friday against the Gauhati High Court order granting bail to Mahanta.
The Gauhati High Court had granted her bail on October 9. Following the decision, the Assam government announced that it would challenge the order before the Supreme Court.
On October 18, Special Director General of Police (CID) Munna Prasad Gupta had announced that the state government would approach the apex court against the bail orders granted to two accused, Amritprava Mahanta and Sandipon Garg.
Assam Advocate General Devajit Saikia had also pointed to alleged discrepancies in the bail order concerning Mahanta. He said certain observations made by the High Court could potentially affect the ongoing trial.
While granting bail, however, the Gauhati High Court observed that the investigation materials and evidence recorded during the trial did not establish a prima facie case against Mahanta regarding the alleged conspiracy and murder. The court clarified that its observations were limited to the bail proceedings and would not determine the final outcome of the ongoing trial.
